The world of Online Poker in India is still quite a grey area when it comes to negotiating the legalities of the game. However recent developments seem to suggest that Poker is seen and is being treated like any other entertainment business. Taxes are being levied on the winnings and earnings people make from online poker. And as soon as taxes come into play, an air of legality is assumed. Currently, winnings of INR 10,000 or more are subject to 30% tax. However, a recent committee set up by the government to look into the taxations on various gambling sources. Headed by Justice RV Easwer (retd), the committee advised raising the bar from what it currently is, INR 10,000 to INR 15,000. To add to this, a number of processes are provided by the Reserve Bank of India for the deposit and withdrawal issues faced by Indian online poker players.
The two fundamental things stated by the online gaming and gambling laws in India is that under no circumstances should there be any sort of FDI (Foreign Direct Investments) in this kind of setups. The other thing which has to be kept firmly in mind is that there is an absolute prohibition of any sort of technical collaboration with foreign entities. In essence, it boils down to the fact that if the company is regular in paying their taxes, having the TDS deducted on players winnings as per the Government rules and regulations and is able to provide fresh and indigenous technology, online poker in India is deemed okay as it may be considered providing a game of skill. The verdict on this consideration is still to come but the results are said to be of the positive nature.
